Patenting Inventions Course 3/3: International Battery Patent Battles

In the first three months of 2021, the U.S. International Trade Commission (ITC) announced two investigations related to patented battery technology. Later in 2021, the ITC is scheduled to issue decisions in two additional investigations relating to lithium-ion battery cells. This talk will present a case study highlighting the impact of the ITC on the battery industry.

This webinar will focus on the following key topics:

    • Why is the U.S. International Trade Commission (ITC) a popular venue for battery litigation?
    • What types of disputes can be litigated before the ITC?
    • Recent activity in ITC battery litigation

Patenting Inventions Course 2/3: Battery Patents at the Patent Trial and Appeal Board

The Patent Trial and Appeal Board (PTAB), within the United States Patent and Trademark Office, provides an alternative to federal court litigation on issues of patent validity. The PTAB conducts trials, including inter partes, post-grant reviews and derivation proceedings, as well as hears appeals from adverse examiner decisions in patent applications and reexamination proceedings. This webinar will review battery patent activity before the PTAB, such A123’s petition to institute inter partes review against Long Hua Technology Co., Ltd’s US Patent No. 7,803,484 directed to LiFePO4 cathodes.

This webinar will focus on the following key topics:

    • Why is the Patent Trial and Appeal Board (PTAB)?

IP Challenges for Foreign Battery Makers in China – Latest Industrial and Legal Trends

China is a key market and a serious player in the lithium battery business, especially for EV and other industrial uses. The Chinese government has enacted policies favoring domestic business, while foreign battery makers are left to their means when navigating a very different legal environment. This creates unique challenges for U.S. and European battery makers trying to enter the Chinese battery market. Securing their IP, protecting their supply chain from illegal infiltrations by counterfeiters, preventing and fighting back IP theft, stopping and deterring infringers and counterfeiters are some of these challenges which they cannot avoid when doing business with China. In this webinar we will provide an overview of these challenges, the risk they pose to the business models and strategies of the foreign right holders for overcoming these challenges. We will also provide useful advise and tips for procuring and protecting IP rights in China.

This webinar will focus on the following key topics:

    • Challenges in the battery business in China from the IP perspective
    • R&D, patent filing strategies and trade secrets
    • Securing supply chain
    • IP theft
    • IP infringement
